There's no easy answer to that. The first thing that has to happen in any case is the person has to get as well as they're going to get. In brain injury cases it's recognized that the recovery, 90% of your recovery, will occur in the first 18 months following the accident. You want to wait that period of time, give it time to see where you're going to wind up. Once you know where you're going to wind up, then you proceed with the lawsuit. Then you proceed to try to settle the case. If you can't, you go to trial. I would say, on average, these cases probably take two years.
